Introduction
This document outlines the Terms and Conditions for using the Saudi Mortgage Guarantees Company (Damanat) Website (hereinafter referred to as the “Company’s Website“).

- Account Creation: In order to create an account on the Company’s Website , the User must be a natural or legal person possessing full legal capacity. The User acknowledges that all information provided during the registration process is true, complete, and up to date, and shall bear sole legal responsibility for any information that is false or misleading.
- Personal Use of the Account: The account created is personal to the User and may not be shared with others, nor may the User disclose login credentials or permit third parties to use the account. The User shall bear full responsibility for all activities conducted through the account, whether authorized by the User or not.
- Confidentiality and Account Protection: The User undertakes to maintain the confidentiality of the login credentials to the account, including the username and password, and shall promptly notify the Company of any unauthorized use or security breach relating to the account.
- Restrictions on Account Use: The Company reserves the right to suspend or terminate the account at any time in accordance with article ten of these Terms and Conditions.
- Number of Accounts: The User may not create more than one account on the Company’s Website without the prior written consent of the Company. The Company reserves the right to merge or delete duplicate accounts without notice.
- Data and Communications: The User agrees that the Company may retain registration data and communications related to the account for purposes of record-keeping or legal compliance, in accordance with applicable regulations.
Usage Restrictions
By using the Company’s Website, you agree to refrain from the following activities:
- Uploading or downloading files containing software, materials, data, or other information you do not own or do not have a license to.
- Uploading or downloading files that contain viruses, corrupted data, or any malicious software, or doing anything that may affect the security, reliability, or continued availability of information on the Company’s Website.
- Publishing, advertising, distributing, or circulating materials or information that contain defamation or violation of any illegal materials or information through the services of the Company’s Website.
- Using any means, program, or procedure to intercept or attempt to intercept the proper functioning of the Company’s Website.
- Engaging in any action that imposes an unreasonable or excessively large load on, or inappropriately uses, the infrastructure of the Company’s Website.
- Everything that is considered a violation of the Anti-Cyber Crime Law or any other laws in force in the Kingdom of Saudi Arabia.
- Creating, displaying, or placing any links related to the Company’s Website, except for placing links related to services on sites whose objectives and general direction do not conflict with the objectives, policies, and frameworks of e-services affiliated with the Company.
- Using automated systems or software to extract data from the Company’s Website for commercial purposes without prior written consent from the Company.
- Attempting unauthorized access to the Company’s or User’s systems or data through the Website, including eavesdropping, intercepting data, or attempting to breach systems.
- Creating or publishing electronic content on the Company’s Website that undermines public order, religious values, public morals, or the privacy of individuals.
- Using the Company’s Website for any illegal or unlawful activity, including the promotion of drugs, pornography, or terrorist content.
- Providing inaccurate or misleading information within Website application forms or inquiries.
- Using the Website’s services for purposes of fraud or forgery.
- Attempting to access information belonging to other Users on the Website without authorization.
Intellectual Property Rights
Users of the Company’s Website are required to refrain from violating or infringing upon any intellectual property rights associated with the Company’s Website, which include but are not limited to the following:
- All contents of the Website, including services and information, are fully protected in accordance with the regulations of the Kingdom of Saudi Arabia.
- The user may not sell, license, rent, modify, copy, reproduce, upload, advertise, transfer, distribute, edit, or create works derived from any materials or contents from the Company’ Website for public or commercial purposes without obtaining prior written approval of the Company.
- It is prohibited to make any modification to the contents of the Company’s Website, and the graphics and images on the Company’s Website may not be reproduced or exploited in any way without the prior written consent of the Company.
- Intellectual property rights shall also include interactive content, electronic forms, real estate data, submission and tracking tools, and all software and design elements used in operating the Website. Any unauthorized use of these elements constitutes a clear violation, and grants the Company the right to take the necessary legal actions.
- The User shall bear full legal responsibility in the event of publishing or sharing any content through the Website that infringes upon the intellectual property rights of third parties, whether such content consists of text, images, designs, or data. The Company reserves the right to remove such content without prior notice.
Website Usage and Disclaimer
- The Company shall not be liable under any circumstances for any direct, indirect, incidental, consequential, special, or exemplary damages arising from the use or inability to use its website.
- All information provided on the Company’s Website is for general and guidance purposes only. The Company makes no express or implied representations or guarantees regarding the completeness, accuracy, reliability, suitability, or availability of the data, information, or related materials on this website. - The Company shall not be liable for any wrongful of willful act done by others through the Company’s Website.
- The Company shall not be liable for any failure to perform its obligations under these Terms and Conditions due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, war, government actions, disruption of technology and communication systems of the service providers or cyber attacks.
- The Company does not guarantee that the Company’s Website will be free from errors, interruptions, or viruses, and the user is responsible for implementing sufficient procedures and checkpoints to satisfy their particular requirements for accuracy of data input and output.
- The Company shall not be held liable for any losses or damages arising from the misuse of the Company’s Website.
- The Company does not guarantee that all electronic services will be available at all times or without interruption. Certain services may be suspended or modified without prior notice for purposes of maintenance, development, or compliance with regulatory requirements.
Security of Website and Its Related Systems
- The Company has a dedicated information security department that ensures the security of the Company’s Website and its related systems in accordance with established security policies and procedures.Penetration tests are performed periodically on the Company’s systems, and performance is monitored while measuring data traffic and maintenance, to enhance security in access and data protection.
- The Company’s Website imposes a high degree of security on all the Website’s equipment and servers, as the latest protection devices are equipped, and the Company makes every effort to examine and test the contents of the Website, and the user must commit to running anti-virus programs in all materials that he/she downloads from the Company’s Website.
- The Company is committed to implementing safeguards against unauthorized access, encrypting sensitive data, and defining access rights based on functional roles, in order to ensure the protection of the information provided through the Website.
- The Company further reserves the right to take all necessary technical and legal measures in the event of detecting any hacking attempt or unlawful use of its systems, including notifying the competent authorities in accordance with the applicable laws of the Kingdom of Saudi Arabia.
- The User shall be responsible for maintaining the confidentiality of their login credentials and shall not share them with any third party. Any transaction or activity conducted through the User’s account shall be deemed the sole responsibility of the User.
Technical and Operational Updates
- The Company reserves the full right to carry out any technical or operational updates or modifications to the Website or the services provided through it, at any time and without prior notice.
- Such updates may include, without limitation: performance enhancements, design changes, addition or removal of features, or security updates.
- The User acknowledges that if he continued using the Website after the implementation of such updates shall constitute implied acceptance thereof.
Voluntary Termination by the User
- The User shall have the right to discontinue the use of the Website or terminate their account at any time, either through the available tools within the Website or by contacting customer support.
- Voluntary termination shall not give rise to any financial obligation towards the Company, unless there is a prior agreement or a paid subscription.
- The Company reserves the right to retain certain data for legal or regulatory purposes in accordance with applicable laws.
User Blocking
The Company reserves the right, at its sole discretion, to terminate, restrict, or suspend the User’s access to the Company’s Website without prior notice and for any reason, including but not limited to a violation of these Terms and Conditions or any conduct deemed unlawful or harmful by the Company. Upon termination, the User shall no longer be permitted to access the Company’s Website.
This includes blocking access to the website’s services, any content, or interactive tools within the Website. The Company further reserves the right to take the necessary legal or technical measures, including notifying the competent authorities, without incurring any liability to the User for any losses or damages resulting therefrom. Continued attempts by the User to access the Website after such blocking shall constitute an additional violation that may give rise to legal accountability.

Upon receiving a complaint, the company will:
- Acknowledge receipt of the complaint.
- Provide an estimated timeframe for addressing the complaint.
- Provide the complainant with a reference number for follow-up.
- Notify the complainant of any progress made on the submitted complaint.
- Inform the complainant, in writing, whether the complaint is accepted or rejected, along with the reasons for the decision.
- Address complaints within (10) business days of receipt.
Judicial Authority
- The user is subject to all laws and regulations in force in the Kingdom of Saudi Arabia. The courts of the city of Riyadh, the Kingdom of Saudi Arabia shall have exclusive jurisdiction to hear and resolve any disputes that may arise in connection with these Terms and Conditions.
- In the event of any conflict between these Terms and any applicable laws or Implementing regulations in the Kingdom of Saudi Arabia, the official laws and regulations shall prevail, and these Terms shall be amended to the extent necessary to ensure compliance, without affecting the validity and enforceability of the remaining provisions.
Acknowledgments
- The user aknowledge that the Company has the right to handle and use the provided data according to the Company’s Privacy Policy.
- The users aknowledge the right of the Company to disclose information or report any act prohibited by the laws of the Kingdom of Saudi Arabia to relevent authorities.
- The user aknowledge that the Company will not be responsible of user’s abuse of other’s owned or licensed IP rights in which occurredd on the Company’s Website or related social channels.
- The user acknowledges that the Company may use cookies and similar technologies to enhance the user experience and analyze site usage.
- The User acknowledges that all information submitted through the Website is accurate and either owned by the User or submitted with proper authorization.
- The user acknowledges that their use of the website’s services is subject to the laws, regulations, and directives in force in the Kingdom of Saudi Arabia, and agrees to fully comply with them.
General Provisions
- The Company shall not be liable for any expenses, losses, costs, compensation, or claims arising in any way whatsoever, general, special, or even incidental, or caused by any action related to the use of the Company’s Website or the information contained therein.
- The Company is not responsible for any consequences resulting from an error or failure to update the information on the Company’s Website.
- The Company reserves the right to add or change any of the terms of use. The continued use of the Company’s Website following any such change constitutes an approval to these Terms and Conditions.
- The Company reserves the right to monitor and record user activity on the Company’s Website for security and quality assurance purposes.
- The Company has the right to temporarily stop the Company’s Website when maintenance, development, or modification is needed, until the completion of such necessary work.
- The Company reserves all rights to stop and disable any link in any way from any website that is not authorized or that contains inappropriate, obscene, defamatory, pornographic, objectionable or illegal topics, or contains names, materials, or information that violate any law or violate any public or private rights.

- The content avaliable on the Company’s Website and related social channels, are general information, and it is subject to change without notice.
- Unathorized use of the Company’s website and its related social channels may give raise to claim for damages and/or be a criminal offence.
- If any provision of these Terms and Conditions is found to be invalid or unenforceable by applicable laws in the Kingdom of Saudi Arabia, the remaining provisions shall continue in full force and effect. - The Company does not provide any legal or financial advice through its Website, and All information displayed is for informational purposes only and shall not be relied upon as a basis for making official or contractual decisions.
- The Company reserves the right to modify or suspend any electronic services provided through the Company’s Website without prior notice, as deemed appropriate for service development or in alignment with regulatory requirements.
- Arabic shall constitute the official and governing language for the interpretation and application of these Terms and Conditions. In the event of any translation, the Arabic version shall prevail.
